SKI UTAH PASSPORT

TERMS AND CONDITIONS OF USE AND RELEASE OF LIABILITY

1. The SKI UTAH Passport is good for three (3) days of skiing or riding for 4th, 5th and 6th graders at each participating Utah alpine ski area during the fall 2023 – spring 2024 season. The SKI UTAH PASSPORT is only good when a participating ski area is open to the public. Individual resort blackout dates and restrictions apply to all Ski Utah Passports.

2. The purchaser and user of the SKI UTAH PASSPORT acknowledges that skiing/snowboarding is an inherently dangerous activity and explicitly agrees to assume any and all risks of injury, property damage, or death associated with his/her participation in the sports of skiing and snowboarding. If the purchaser of the SKI UTAH PASSPORT can no longer use their pass due to injury or any other reason, the pass is non-refundable.

3. The Utah Ski & Snowboard Association/Ski Utah and the ski areas honoring the SKI UTAH PASSPORT do not assume responsibility for weather, snow conditions, or any other factor that may prevent the pass holder from receiving the full benefit of the pass.

4. The holder of this SKI UTAH PASSPORT is subject to all rules and regulations in effect at each ski area; the holder is not entitled to any special privileges or exemptions. The purchaser acknowledges that Utah law provides that "no skier may make any claim against, or recover from, any ski area operator for injury resulting from any of the inherent risks of skiing." Utah Code Ann. '78-27-53. Your lift ticket may be confiscated by the management of any ski area if, in its judgment, the pass holder fails to obey rules and/or directions. Any resort may revoke a SKI UTAH PASSPORT holder's use of the pass if, at the resort's discretion, the holder of this pass should have skiing/snowboarding privileges revoked without refund.

5. Your SKI UTAH PASSPORT may be canceled, without any refund, at the discretion of the Utah Ski & Snowboard Association/Ski Utah, if you abuse your skiing/snowboarding privilege by acts, which endanger yourself or others, or by willful violation of any SKI UTAH PASSPORT terms and conditions. Skier/snowboarder days are accounted for at each ski area.

6. Your SKI UTAH PASSPORT is non-transferable. Lift tickets will only be issued for the same day they are redeemed at the ticket window. Each SKI UTAH PASSPORT redeemed for a lift ticket (at participating Resorts) will be held until you are observed attaching the lift ticket to your clothing. Lift tickets received in exchange for your SKI UTAH PASSPORT may not be sold or transferred on or off ski area premises. The ski areas can confiscate lift tickets and violators are subject to prosecution for theft of services for SKI UTAH PASSPORT users reselling their lift tickets on or off the ski area premises. The Utah Ski & Snowboard Association/Ski Utah reserves the right to revoke without refund or refuse sale of the SKI UTAH PASSPORT to anyone who willfully violates any SKI UTAH PASSPORT or ski area rules or directions.

7. No refunds for the SKI UTAH PASSPORT will be issued for any reason. All SKI UTAH PASSPORT sales are final.

8. Purchaser agrees to release from liability, to defend, indemnify, and hold harmless the Utah Ski & Snowboard Association/Ski Utah, and participating ski areas, their respective employees, agents, officers and associated corporate entities from any and all claims arising out of the use of the SKI UTAH PASSPORT, including for claims resulting allegedly from the Utah Ski and Snowboard Association's, Ski Utah's and/or any participating ski area's NEGLIGENCE.

9. Severability: To the extent any portion of this Agreement is deemed unenforceable, all other portions of this Agreement will remain enforceable to the fullest extent of the law.

COST OF SKI UTAH PASSPORT: $69 plus Utah state sales tax until November 30. $89 plus Utah state sales tax on December 1 until sales close in April 2024.

Jurisdiction Limitation - As a condition of using a ski area's facilities, I and anyone using my SKI UTAH PASSPORT as my assignee or successor-in- interest agree(s) that any litigation or arbitration that is initiated for my or her/his benefit against a Utah ski area shall be brought in the appropriate Federal Court in Utah or the State Court in the County in Utah where that ski area has its mountain operation headquarters and that the laws of the State of Utah shall apply.

 

Yeti Pass Terms & Conditions

SKI UTAH YETI PASS
TERMS AND CONDITIONS OF USE AND RELEASE OF LIABILITY

1. The YETI PASS is good for one (1) day of skiing at each participating Utah alpine ski area during the 2023-24 season. The YETI PASS is only good when a participating ski area is open to the public.

2. The purchaser and user of the YETI PASS acknowledges that skiing/snowboarding is an inherently dangerous activity and explicitly agrees to assume any and all risks of injury, property damage, or death associated with his/her participation in the sports of skiing and snowboarding. If the purchaser of the Yeti Pass can no longer use their pass due to injury or any other reason, the pass is non-refundable

3. The Utah Ski & Snowboard Association/Ski Utah and the ski areas honoring the YETI PASS do not assume responsibility for weather, snow conditions, or any other factor that may prevent the pass holder from receiving the full benefit of the pass.

Acknowledgment of Risks

As the parent, guardian or other legal representative of such minor child, I understand and am aware that there are numerous inherent and other risks involved in participating in ski or snowboard lessons, which could cause serious injury or death to my child. Snowboarding and skiing are action sports in which accidents and injuries occur. I understand and acknowledge that students taking a "first time" lesson may ride a ski lift either alone, with another child or with an adult at some point during that lesson and that such minor child may ski at Alta or Deer Valley or ski or snowboard at Beaver Mountain, Brian Head, Brighton, Park City Mountain Resort (Park City Base or Canyons Village Base), Snowbasin, Snowbird Resort LLC, Solitude, Sundance, Nordic Valley, or Woodward.

I agree and understand that skiing and snowboarding are purely voluntary recreational activities and that if I am not willing to acknowledge the risks, then I should not allow my minor child to go skiing or snowboarding at any resort and should not allow my child to participate in this school program. I further acknowledge that Ski Utah, the Utah Ski and Snowboard Association and/or the ski area will not be held liable for any injuries sustained by my minor child as a result of skiing or snowboarding before, during or after the ski or snowboard lesson.

Ski or Snowboard Rentals

If my child receives his/her equipment on-site at the resort, I understand that the binding's settings for my child's equipment will be fixed according to industry standards for my child's height, weight, shoe size, age and ability level. I acknowledge that I will not be able to view the setting, and understand that the rental shop will set the equipment according to the height, weight, shoe size, and age and ability level from the information that I have correctly supplied on the rental agreement. In the event that equipment from an off-site shop does not fit properly upon my child's arrival at the resort, I understand that the ski area reserves the right to change it to the correct size and/or have it adjusted properly by a certified technician.

Authorizations

In the event a medical emergency exists relative to my minor child, I hereby authorize each ski area company as listed above and it's representatives, employees, agents, officers and directors to take such reasonable action to care for such minor child, in addition to calling for medical care and emergency services, as is necessary or helpful in their opinion, and agree to pay for any medical expenses or costs, including transportation incurred in doing so.

Photo Release

In the event that my child is photographed while at the ski resort for his or her Ski Utah lesson, I give Ski Utah and the participating resort permission to use this photograph for marketing purposes to promote the Ski Utah school program.

Jurisdiction Limitation

I agree that any litigation, arbitration or mediation against any ski area company, Ski Utah or the Utah Ski and Snowboard Association shall be brought in the state of Utah and that the laws of the state of Utah shall apply.
